These Terms and Conditions ("Terms") govern your access to and use of the Chicago Shredder website and the services offered through it. Chicago Shredder is operated by STS Electronic Recycling, Inc. ("STS," "we," "us," or "our"), headquartered in Jacksonville, Texas, and is part of the STS Recycling Family. By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the website and our services.
1. Services
Chicago Shredder provides electronics recycling, IT asset disposition, hard drive destruction, lamp and bulb recycling, ink and toner recycling, recycling bin programs, and related services to businesses, government agencies, property managers, and organizations in the Chicago metropolitan area and surrounding Midwest region. All electronics are processed through STS Electronic Recycling, Inc.'s R2v3-certified facility. Services are subject to availability, scheduling, geographic coverage, and applicable pricing in effect at the time of service.
2. Quotations and Pricing
All quotations are estimates based on the information provided at the time of request. Final pricing may vary based on actual materials, quantity, volume, weight, condition, access conditions, and service requirements determined at the time of pickup. We reserve the right to adjust pricing if actual conditions differ materially from the original estimate. Quotations are valid for the period stated on the quote or, if none is stated, for thirty (30) days from issuance.
3. Scheduling and Service Response
We typically respond to service inquiries within one business day. Pickup and service appointments are scheduled by mutual agreement and may be affected by weather, routing, volume, and_circumstances beyond our reasonable control. We will make commercially reasonable efforts to honor scheduled appointments and will communicate any necessary changes promptly.
4. Customer Responsibilities
You are responsible for ensuring that all materials presented for recycling or destruction are your property or that you have the legal authority to authorize their disposal. You warrant that materials do not contain hazardous substances beyond those inherent in standard electronic equipment, and that you have disclosed any known hazards. You are responsible for backing up and removing any data or materials you wish to retain prior to pickup. Title to and risk of loss for materials transfers to STS upon collection, except as otherwise agreed in writing.
5. Data Destruction
Our hard drive and data destruction processes are designed to render data unrecoverable. Drives processed at our Addison, IL facility may be physically destroyed on-site using our hard drive crusher, providing witnessed physical destruction that meets DoD-standard requirements (DoD 5220.22-M). Where applicable, data sanitization follows NIST SP 800-88 guidelines. A Certificate of Data Destruction documenting the method applied is available upon request. While we apply industry-standard processes and provide documentation thereof, organizations with specific regulatory compliance requirements should consult their own legal counsel to confirm that our services support their obligations.
6. Environmental Handling
Materials are processed through STS Electronic Recycling, Inc.'s R2v3-certified facility, and no materials are knowingly disposed of in landfills. Downstream partners are vetted for certification status. We handle materials in a manner designed to support responsible environmental stewardship and applicable regulations.
7. Limitation of Liability
To the maximum extent permitted by applicable law, STS Electronic Recycling, Inc. and Chicago Shredder shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from use of our website or services, including loss of data, profits, or business opportunity. Our total aggregate liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law.
8. Indemnification
You agree to indemnify and hold harmless STS Electronic Recycling, Inc., its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, and expenses arising out of your breach of these Terms, your violation of any law, or your misrepresentation regarding the materials presented for service.
9. Intellectual Property
All content on this website, including text, images, logos, graphics, and design elements, is the property of STS Electronic Recycling, Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our express written permission.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under or relating to these Terms shall be resolved in the state or federal courts located in Cherokee County, Texas, and you consent to the personal jurisdiction of those courts.
11. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with any service agreement and our Privacy Policy and Cookie Policy, constitute the entire agreement between you and STS regarding the website and services and supersede any prior understandings.
12. Changes to These Terms
STS Electronic Recycling, Inc. reserves the right to update these Terms at any time. The revised version will be posted on this page with an updated date. Continued use of the website or services following any changes constitutes acceptance of the revised Terms.
